Dutch law and routes to Open Access: a national copyright law pilot project as an inspiring example?

The aim of the workshop is to present the outcome of the pilot and inspire policy makers, librarians and researchers in other countries to employ legal possibilities to maximise the use of Green Open Access. The workshop will focus on possible legal routes and their translation to uniform guidelines and present the implementation in a comparative case study of two Dutch universities.

Workshop abstract

An Open Access provision was adopted in Dutch copyright law in 2015, permitting researchers to make their publicly funded work available to the public after a reasonable period of time. The provision caused great excitement in the Netherlands, but failed to have any practical impact, partly because of the way it was phrased. Its abstract terms left both researchers and library staff uncertain on how to act upon the right.
In 2018 a coalition of twelve Dutch university libraries drafted guidelines for the execution of the provision and a pilot was started for the practical implementation in their university repositories. The guidelines give researchers specific directions on how to share journal articles, conference proceedings and book chapters published in ‘edited volumes’ regardless of any restrictive publisher’s license terms or guidelines. The guidelines allow sharing the original published version of record with a uniform embargo period of six months after the date of the first online publication.
In the first three months of 2019 a substantial number of researchers participated in a pilot endorsed by the Association of Dutch Universities. All participants signed an agreement granting the university a non-exclusive license to upload all elligble publications published in 2018 and 2019 in the university library repositories.
The pilot proved to be very popular and resulted in the Open Access publication of a considerate percentage of academic output of the participating institutions.
